Abstract

This article considers if use of the internet by jurors to communicate with defendants in, or access information about, cases they are trying poses a challenge to the concept of trial by  jury and the administration of justice, or whether a juror's disregard for the principle that a verdict can only be based on the evidence given in court is more problematic. Examines three cases where a juror's use, or potential use, of the  internet was considered a danger to the trial. Notes the requirements for a trial by  jury in Ireland, and the need for judges to consider the nature of the warnings they issue to jurors.
